Application to register the addition, upgrading, relocation or decommissioning of a charging point
Publicly accessible charging infrastructure must be operated under an Authorisation issued by the Regulator for Energy and Water Services(REWS) under the Publicly Accessible Electric Vehicles Charging Infrastructure Regulations, 2022 (LN 226 of 2022).
Any person wishing to act as an operator of publicly accessible charging infrastructure is required to apply in writing to the Regulator for Energy and Water Services and to obtain a PCIO Authorisation issued by the Regulator

Each publicly accessible charging point shall be registered with the Regulator for Energy and Water Services within fifteen (15) days as from the date of the commissioning of such charging point.
Any changes to an existing charging point such as an upgrade, transfer and relocation shall be notified to the Regulator within fifteen (15) days from the date of such upgrade, transfer or relocation. A publicly accessible EV charging point may only be transferred to a REWS authorised PCIO.
The decommissioning of a charging point must be notified within one day from the decommissioning of such a charging point.

- A copy of the I.D. Card/passport details of the applicant; or of all the Signatory/Signatories in case of a Company/Organisation or Partnership. (Copies from a mobile photo are not accepted).
- A recent police conduct certificate (not earlier than three months) of the applicant in the case of a natural person or of all directors in case of a limited liability company or the responsible person(s) as indicated in the statute or instrument of constitution for any other legal organisation or entity.

- a company, a copy of the Memorandum and Articles of Association of the Company or a Board Resolution authorising the person to legally represent the company together with a copy of a memorandum and Articles of Association of the Company is required to be submitted
- an organisation, a copy of the Statute,
- a sole trader, a copy of the VAT certificate,
- a partnership, a copy of the deed of Partnership.
- A brief operational plan including the organisational set-up of the operator, the planned number of charging points, type and location that will be operated under this authorisation.
The following fees apply:
- A non-refundable application fee of five hundred Euro (€500) for a new authorisation application or renewal of an existing authorisation,
- A fee of seventy-five Euro (€75) for each charging point payable every three years from the date of issue the authorisation to act as a PCIO or on any other date as the Regulator may establish.

In the case of a new application, the name of applicant/Identification Card or company registration number, as applicable, and purpose of payment must be specified with the payment.
In the case of an application for renewal of an authorisation, the REWS PCIO authorisation number must be specified with the payment.
In the case of the authorisation fee per charging point, the REWS PCIO reference number must be provided with the payment.
An Authorisation to act as an operator of publicly accessible charging infrastructure is valid for twelve (12) years.
The Publicly Accessible Electric Vehicle Charging Infrastructure Regulations, 2022(LN 226 of 2022) establish the following penalties:
- Suspension of an Authorisation that remains not renewed after the final notice from the Regulator – (Regulation 3 (15),
- Suspension, revocation or cancellation of the Authorisation for any of the reasons set out in Regulation 6.
In addition, Regulation 17 of these regulations establishes that the Regulator may impose an administrative fine upon any person who infringes any provision of the regulations or of an authorisation condition or approval issued thereunder or who fails to comply with any directive or decision given by the Regulator in ensuring compliance with these regulations. Such administrative penalty shall not exceed one hundred thousand Euro (€100,000).
In the case of an application for an Authorisation to act as an operator of publicly accessible charging infrastructure, Regulation 3(8) of the Publicly Accessible Electric Vehicle Charging Infrastructure Regulations 2022 (LN 226 of 2022) establishes that the Regulator shall communicate to the applicant in writing within a reasonable time, which shall not be of more than six (6) months from the date of receipt of a valid application. It is envisaged that, in practice, the Regulator should be able to issue such an authorisation within two (2) months from the receipt of a valid complete application.
In the case of an application for renewal, Regulation 3(9) establishes that an application for the renewal of an Authorisation must be submitted in writing to the Regulator six (6) months prior to the date on which the authorisation expires.
In general, the Maltese Administrative Law establishes that, in the absence of a reply by the Regulator, this is construed to be tantamount to a refusal and the applicant has a right to appeal.
Any decision taken by the Regulator for Energy and Water Services, including refusal of an application for or withdrawal of an Authorisation or a licence, may be subject to appeal before the Administrative Review Tribunal established by Article 5 of the Administrative Justice Act.
