Application to Become an Authorised Electrician

Authorisation A for Carrying out Installation, Alteration, Extension and Certification of Single-Phase Electrical Installations

Authorisation B for Carrying out of Installation, Alteration, Extension and Certification of Single-Phase Electrical Installations and Three Phase Electrical Installations Rated up to 300 Amps per Phase

1: Authorisation A and Authorisation B

The Regulator for Energy and Water Services issues Authorisations A and Authorisation B to competent persons under the Electrical Installations Regulations (S.L. 545.24).
Any person wishing to be issued with an Authorisation A or an Authorisation B is required to apply in writing to the REWS using the appropriate forms below.
 
Prospective applicants are required to sit for an examination for the relevant authorisation (A or B) held for such purpose by the Examinations Department and achieve a pass in the relevant examination. – Further details may be obtained from  https://exams.gov.mt/articles/Boards/Local_Licences_Examinations.aspx.

Prospective Applicants that do not sit for the examination held by the Examination Department in Malta, but hold an alternative academic qualification, must submit with their application:

  • original copies of such certificates and
  • a certificate from the Maltese National Commission for Further and Higher Education – NCFHE (http://www.ncfhe.gov.mt/) assessing the relevant academic qualifications presented by the applicant and providing their equivalent MQF Level.

Applicants will be required to sit for and be successful in an interview held by the Regulator for Energy and Water Services as a means of competency assessment prior to issuance of the relevant Authorisation.  Applicants are expected to be able to communicate in Maltese  and/or English.

3: Means of Authentication, Identification and Signature

  • Details / number of the Identity card or passport.
  • Handwritten signature on application form.

4: Type of Evidence to be Submitted

  • Copy of the identity card or passport of the applicant.
  • In the case of an application for Authorisation A, the applicant must provide documented evidence of work experience of a minimum of 12 months in single phase electrical installations and conducted under the supervision of an Authorisation A or B holder, or a warranted electrical engineer. Such evidence must be endorsed by the supervisor.
  • In the case of an application for Authorisation B, the applicant must provide documented evidence of work experience of a minimum of 24 months in three phase electrical installations and conducted under the supervision of an Authorisation B holder or a warranted electrical engineer.  Such evidence must be endorsed by the supervisor.

For all applicants:

  • The applicant must submit a declaration issued by a Medical Doctor as specified in the application form certifying that the applicant is not affected by a colour blindness condition which may be an impairment resulting in an unsafe and improper execution of electrical wiring installation works.
  • The applicant must present a police conduct certificate issued not more than 3 months prior to the date of the application.

Qualifications: 

  • A copy of the letter issued by the Examinations Department indicating the successful completion of the Wireman Examination; or
  • In case of a warranted electrical engineer applying for an authorisation, a copy of the warrant.  In the event that the warranted engineer is not listed in the last Government Gazette notice of warranted engineers, the transcript of engineering degree course issued by the University is also required to be submitted.  
  • In case of alternative qualification(s) being submitted the following additional documents are required to be submitted:
    • an authenticated copy of such certificates with respect to the alternative qualifications;
    • a copy of the certification issued by the National Commission for Further and Higher Education (NCFHE) confirming that the alternative qualifications being submitted are recognised as being equivalent to the qualification level required in the application;
    • the courses’ contents and syllabi of the alternative qualifications being submitted such as to enable assessment by the Regulator.

5: Applicable Fees

  • The application fee for an Authorisation A or B is €12 (twelve euro)
  • The Authorisation fees are:
    •  €35 (thirty-five euro) every three years in the case of an Authorisation A holder.
    • €70 (Seventy euro) every three years in the case of an Authorisation B holder.

6: Penalties and Offences

The Electrical Installations Regulations (S.L. 545.24) establish the following penalties:

  • late payment fee of €12 (twelve euro) if an authorisation is not renewed within 30 days (January) as provided by the Regulations- (Regulation 8 (3));
  • Suspension of an Authorisation that remains not renewed after the final notice from the Regulator – (Regulation 8 (5));
  • Suspension of the Authorisation for a determinate period of time in case of any breach listed in Regulation 11.  The list of breaches includes:
    • breach of these regulations;
    • failure to comply with the requirements of these regulations;
    • failure to comply with the requirements of an authorisation issued by any authority having jurisdiction for electrical installation works;
    • failure to rectify defective installations or electrical equipment pursuant to a written warning issued by any other authority or by a distribution system operator;
    • failure to pay any fee properly chargeable under these regulations.
  • A fine of €200 (two hundred euro) for each may be imposed by the Regulator for each day of non-compliance in the case that an authorised provider does not comply with the direction from the Regulator to rectify any confirmed malpractices or defects – (Regulation 24);   
  • A fee of €30 (thirty euro) is applicable for the replacement of lost or destroyed Authorisation identification card – (Regulation 25);
  • A penalty between €1,000 (one thousand euro) and €100,000(one hundred thousand euro) in the case an unauthorised person is found guilty of using an Authorisation identity card to purport that he/she holds a valid authorisation – (Regulation 25).

In addition, the Regulator for Energy and Water Services Act provides that:

  • any person who carries out any such activity without a licence or who acts in breach of any condition of such licence, shall be guilty of an offence and shall be liable on conviction to a fine (multa) not exceeding one hundred and fifteen thousand euro (€115,000) or to imprisonment for a term not exceeding two years, or to both such fine and imprisonment;
  • the Regulator may impose an administrative penalty upon any person who infringes any provision of the Act, or  regulations prescribed thereunder or of any other law which the Regulator is entitled to enforce, or who fails to comply with any directive or decision given by the Regulator or who fails to comply with any condition  of any authorisation granted under the Act.  Such administrative penalty shall not exceed:
    • one hundred thousand euro (€100,000) for each contravention and, or six hundred euro (€600) for each day of non-compliance, from the date of the decision given by the Regulator; and, or
    • in the case of an undertaking (including a vertically integrated undertaking) or a body corporate, up to 10% of the total turnover concerned in the preceding business year. Provided that in the case of an undertaking, including a  vertically  integrated  undertaking  or  a  body corporate, a fine of up to 10%  of the annual turnover  concerned  in  the  preceding  business  year, which  amount  exceeds  one  hundred  thousand  euro (€100,000) may, in any such case be imposed.

7: Deadlines or Indicative Time that the Regulator Requires to Complete the Procedure

A decision on a complete and valid application is given by the Regulator for Energy and Water Services in writing within three (3) months from the date of the application. (Regulation 7(3)).

8: Rules on Lack of Reply from the Regulator and Legal Consequences

In general, the Maltese Administrative Law establishes that in the absence of a reply this is construed to be tantamount to a refusal and the applicant has a right to appeal.

9: Means of Redress or Appeal

Any decision taken by the Regulator, including refusal of an application for or withdrawal of an authorisation or a licence, may be subject to appeal before the Administrative Review Tribunal established by Article 5 of the Administrative Justice Act.
